The agreement between Fabulous Limited and the person or organisation running a community on success.digital.

Who this is between

These terms are between Fabulous Limited, a company incorporated in the United States (“we”, “us”), and the person or organisation that creates a community on success.digital (“you”, “the host”).

They are not between us and the members of your community. Your members agree to your terms about what may be said and done in your community, not ours. We hold and serve that community for you; what it is for and who belongs in it are yours.

What we provide

Software that runs a community: a feed, discussions, events, courses, direct messages, member profiles and the settings that shape them. We host it, keep it running, and apply security updates. We do not moderate your community, write its rules, or decide who may join it.

What you are responsible for

What you may not do

Use the platform to break the law; to host material that sexualises children; to send unsolicited bulk email; to attack, probe or overload the service or anybody else’s community; to resell access to the software itself as though it were yours to license; or to work around a limit we have set on your plan.

Your data is yours

Your community’s content and your members’ personal data belong to you and to them. We process it to run the service and for no other purpose: we do not sell it, we do not use it to train models, and we do not use it to advertise to your members.

You can export a community’s data at any time while your account is open, and each of your members can export their own. See the data-processing addendum for how we handle it and the privacy policy for what is held and where.

Stopping

You can close your community at any time, from its settings. Closing it makes it unreachable immediately. Take your export first; we delete a closed community’s data after thirty days, and after that it is gone rather than archived.

We may suspend a community that is breaking these terms. Except where the law requires otherwise or somebody is in danger, we will tell you what is wrong and give you a reasonable chance to fix it before we do.

What we do not promise

We do not promise the service will be uninterrupted or error-free. We keep backups and we will do our best, but you should keep your own export of anything you cannot afford to lose. We are not liable for indirect or consequential loss, and our total liability in any twelve-month period is limited to what you paid us in that period.

Nothing here limits liability that cannot be limited by law — including for death or personal injury caused by negligence, or for fraud.

Changes

We may change these terms. If a change materially reduces what you get or increases what you owe, we will tell you at least thirty days before it takes effect, and you may close your community and leave rather than accept it.

Law and disputes

These terms are governed by the law of [state of incorporation], United States, and the courts there have exclusive jurisdiction.
